• Grounds for Postponement of Elections: (1) Force Majeure; (2) Violence; (3)Terrorism; (4)
Loss or Destruction of Election Paraphernalia; and (5) Analogous Causes.
• It is impossible to hold a free and orderly election.
• The ground must exist before the end of voting/ transmission of results.
• COMELEC en banc can declare Postponement of Elections either via a petition or motu proprio.
Cannot be decided on by the BEI or Election Officers.
• Special Elections within 30 days from cessation.

FAILURE OF ELECTIONS
• Grounds for Failure of Elections: (1) Force Majeure; (2) Violence; (3) Terrorism; (4) Fraud and
(5) Analogous Causes.
• There is a Failure to Elect and it affects the results of the elections.
• The Election is not held or is suspended – (1) after the voting; (2) during the preparations or
transmission of the Election Returns; or (3) during Canvassing.
• COMELEC can declare a Failure of Election upon petition.
• Special Elections within 30 days from cessation
